The "Green Dragon Clear Challenge" (the "Promotion") is sponsored by Nexon America, Inc., 222 N. Sepulveda Blvd., Suite 300, El Segundo, CA 90245 ("Nexon" or "Sponsor").
The Promotion is open only to legal residents of one of the 50 United States (including DC), Canada (excluding Quebec), Australia, and New Zealand who are: (a) at least eighteen (18) years of age as of the start of the Promotion Period (defined below) or have reached the age of majority in their jurisdiction of residence, whichever is older; (b) are registered users of Dragon Nest (the "Game"); and (c) have never been subject to a ban or other disciplinary action on any of Sponsor's games (including but not limited to Dragon Nest). Employees, officers, directors, and agents of Nexon America, Inc. or any subsidiary, parent, or affiliate company thereof, as well as the immediate family (defined as parents, children, siblings and husband or wife) or cohabitants of any such person, are not eligible to participate. The Promotion is void where prohibited.
Participation in the Promotion constitutes the participant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. Any use of Sponsor's Web Site (hereinafter defined) and/or the Game (hereinafter defined) is subject to all of Sponsor's policies, terms and conditions related thereto (including without limitation any Terms and Conditions and End User License Agreements), and are specifically incorporated into these Official Rules by reference. All entrants are expected to comply with all such policies and terms, and a violation thereof shall constitute a violation of these Official Rules.
The Promotion begins at 12:00 a.m. Pacific Time ("PT") on February 20, 2013 and ends on the earlier of: (a) the time when the final winner is determined; or (b) 11:59:59 pm on March 31, 2013 (the "Promotion Period"). Entries that are submitted before or after the Promotion Period will be disqualified and will not be considered for winner determination. Sponsor's computer will be the official timekeeping device for this Promotion.
The participate in the Promotion, entrants must first register for Sponsor's service. Registration is free and may be completed www.nexon.net (the "Web Site"). After initial service registration is complete, entrants may download a copy of the Game. Downloading a copy of the Game is free (subject to an individual's Internet usage service agreement, which is between the entrant and the Internet Service Provider).
Once the Game has been downloaded, entrants must visit the following thread: THIS SHOULD BE DONE PRIOR TO ATTEMPTING TO CLEAR THE NEST, AS THE TREAD WILL CONTAIN ADDITIONAL INSTRUCTIONS THAT ARE REQUIRED FOR ENTRY. You must comply with all of the instructions posted to the thread in order to participate. If you do not make the required posting, you may not be considered a valid participant in the Promotion and your run may not be eligible to win a prize.
Once the entrants have made the required posting to the thread, they must log into the Game using their Nexon username and password. Once in the Game, entrants will form teams of at least two (2), but no more than eight (8), players. Who you select as your team members is up to you. Each team of entrants must designate one entrant as the "Party Leader," who will be responsible for all communications between the team and Sponsor.
After forming the team, the team must clear the Green Dragon Nest, and the run through the nest must be recorded in a format that is capable of being uploaded to YouTube. All videos must comply with the following requirements, which will be subject to Sponsor's sole and absolute determinations:
Throughout the Promotion Period, Sponsor will monitor uploads of videos to ensure compliance with the above. Any video that does not comply with any of the above will be disqualified (though it may not be removed from the YouTube thread).
Limit: Each team may upload only one (1) video. Any videos submitted by a particular team after the initial video submission will not be reviewed. Sponsor will determine in its sole discretion whether a team has submitted more than one video. There is no limit on the number of teams that any one participant can join.
The winners of the Promotion will be the first ten (10) teams to upload a video showing successful completion of the run without violating any of these Official Rules (such a video will be referred to as a "Submission"). The first team to upload a Submission will be the potential First Prize Winner. The second team to upload a Submission will be the potential Second Prize Winner. The third team to upload a Submission will be the potential Third Prize Winner. Finally, the fourth through tenth teams upload a Submission will be the potential Fourth Prize Winners. Determinations of potential winner status are subject to Sponsor's sole judgment and discretion.
After the potential prize winners are chosen, Sponsor shall send a notification to each Party Leader of each potential prize winner via e-mail. This e-mail will include a request for the first name, last name, and login information for each member of the team. Team leaders shall have seven (7) days to respond to Sponsor's message and supply the requested login information to be eligible to receive the applicable Prize. Upon receiving a full and complete response, Sponsor will determine whether all members of the potentially winning team are eligible to win, validly registered for the Game, and in good standing with the Web Site (e.g., not subject to disciplinary action). Upon verification as set forth herein, the Prize will be delivered to the Winners within 30 days after verification. Disqualification and the selection of an alternate winner may result from any of the following: (a) violations of these Official Rules; (b) a member of the team has been banned, suspended, or subject to other disciplinary action for any of Sponsor's games; (c) Sponsor's verification notice has been returned as undeliverable; or (d) the Party Leader does not respond for in the set time period with the required information for all team members. In the event of disqualification, a new winner will be chosen based upon the team who was the next in time to submit a Submission, with all previously identified potential prize winners moving up in order, if applicable.

The prizes will be split equally (or as equally as possible) among all members of a team. If Sponsor is unable to divide the prizes equally among all members of a team, Sponsor will divide the prize as equally as possible and will give any remainder to the Party Leader. Sponsor will rely on all communications with the Party Leader as evidence of the identifies of the team members. Sponsor is not responsible for any inaccurate information from the Party Leader, and all entrants agree to release Sponsor from any and all claims that they were not named as a team member. Please allow up to six (6) weeks for delivery of prizes. Prizes may be delivered in either digital or hard copy formats, as determined by Sponsor in its sole discretion.
Limit: any entrant may receive only one (1) prize (or share thereof, as may be applicable). An entrant who is a member of multiple prize winning teams will not receive any additional prize, and instead the remaining members of the team that wins the lower value prize will split that prize among themselves. Prizes are not transferrable, and may not be redeemed for cash. Sponsor reserves the right to substitute a prize of equal or greater value for any reason whatsoever. Prize must be accepted as awarded. Any entrant who rejects the prize as awarded may cause disqualification of the entire team and a corresponding loss of the entire prize. Winners will be responsible for payment and reporting of all applicable taxes associated with the receipt and usage of a prize. Sponsor may report the receipt of any prize to the appropriate federal, state, or local taxing agency(ies).
By submitting a video as part of the Promotion, each Party Leader represents and warrants, on behalf of every team member, that: (i) the Party Leader has been duly elected by all members of the team; (ii) the Party Leader has the express written permission of all team members to communicate with Sponsor on behalf of the team and to send to Sponsor via e-mail the requested personal and log-in information of each team member; (iii) the video conforms to all of the requirements of these Official Rules; (iv) each team member has read and understood these Official Rules and agree to be bound by them; and (v) all team members will continue to comply in full with these Official Rules until the Promotion has ended and all prizes have been awarded.
By submitting an Submission, each entrant (either as the Party Leader or through the Party Leader):
Except as set forth herein, all information submitted by Participants in the Promotion will be treated according to the Sponsor's Privacy Policy (http://www.nexon.net/legal/privacy-policy/). Except where prohibited, participation in the Promotion constitutes each entrant's consent to the Sponsor's use of his/her name, likeness, voice, opinions, biographical information, and country and state or province of residence for promotional purposes in any media without further payment or consideration.
By entering and participating in this Promotion, each entrant agrees to defend, indemnify and otherwise hold Nexon America, Inc., its parent, subsidiary, and affiliate companies, and all agents, officers, directors, and employees of all of the above (collectively the "Released Parties") harmless from and against any and all liability of any nature whatsoever arising out of or relating to (a) any technical errors that may prevent entrants from participating in any way; (b) unauthorized human intervention in the Promotion; (c) errors in the administration of the Promotion; and (d) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from an entrant's participation in the Promotion or receipt or use of any prize, including any such claim by Nexon's employees or any third parties. Each entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the Released Parties be liable for attorney's fees. Each entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal courts located in Los Angeles County, California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the entrant's rights and obligations hereunder, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.
In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, Sponsor may, in its sole discretion, either (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules or (b) award the prizes from among the Submissions received up to the time of the impairment. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision. The Promotion is void where prohibited.
